Our office tenaciously litigates all cases with an eye toward speedy resolution by settlement when possible, early disposition upon motion when feasible or successful outcome at arbitration or trial when necessary.

We have served as counsel to numerous companies, businesses and individuals involved in disputes at the state court level. We have a well-established reputation for reaching a timely resolution in mediations, where possible, or in courtrooms or arbitrations when required.

Transactions

Our office represents clients in the acquisition, disposition, leasing, financing, renovation and “greening” of commercial and residential real estate in California. We counsel buyers, sellers, lenders, borrowers, property owners, landlords, tenants, and investors on the full range of issues related to both routine and highly complex real estate transactions. The office has a wide-ranging knowledge of transactional real estate issues with a focused business-oriented perspective.

Entity Formation

LLCs (limited liability companies) combine the limited liability nature of corporations with many of the aspects of partnership. However, LLCs are often favored for their great flexibility in how their ownership and management can be structured and how the company can be taxed.

When utilization of an LLC is appropriate, we can advise you as to your options and obligations throughout the business formation process in order to form an LLC to protect your rights and interests so that you may succeed in pursuing your objectives.

Appointed Receiver and Partition Referee

While courts may themselves recommend the appointment of a particular attorney to serve as a Court Appointed Receiver or Partition Referee, more often than not, judges leave the recommendation for selection up to the legal counsel.

Our office has been named by the petitioning party and approved by the courts, either by stipulation or via the moving papers in a contested setting. As Partition Receiver or Referee, the object is to act in the best interests of all of the owners by maximizing the value of the property in controversy, most often by sale over the objections of one or more parties.

Mediation

CUSTOMIZED SOLUTIONS FOR UNIQUE PROBLEMS

Every dispute is unique and deserves the conflict resolution services of an experienced neutral who can help parties arrive at a fair and satisfactory outcome. Mediation is a confidential process which allows the parties to optimize their results as quickly, painlessly and cost-effectively as possible. Harry I. Price, Esq., an attorney with over 46 years litigation and negotiation experience, has been selected to serve as mediator by counsel in over 250 contested real estate litigation matters to serve as a neutral to assist disputing parties in creating a customized resolution that takes into account their needs, interests and concerns. While the goal is to obtain an outcome that is satisfactory to all parties, bear in mind that compromise by definition means that a “successful” outcome may be equally unsatisfactory to all parties. Mr. Price conducts hearings in person, remotely, and via hybrid models, and works to create a positive mediation experience for all while facilitating mutually acceptable settlement agreements.
